This cancels all previous issues and is subject to withdrawal without prior notice. These apply to individual contracts with customers and all quotations are made and orders accepted on and subject to the terms and conditions. E & O.E.
- Price. All prices quoted are nett and exclusive of V.A.T. We reserve the right to change prices if necessary. Plants will be invoiced at prices ruling at the time of despatch or collection. We reserve the right to add a handling charge for small quantities.
- Payment. Accounts are due strictly 30 days from date of invoice. Interest at a rate of 2% per month will be added to cover overdue accounts. Non-account customers are requested to make payment on delivery or collection. A credit account is available subject to satisfactorily completing a Mahood Brothers Ltd Credit Application Form.
- Legal Title. All goods, whether collected or delivered, remain the property of Mahood Brothers Ltd until paid in full. However, the liability for the goods shall pass to the customer upon receipt of delivery.
- Notwithstanding risk in the goods passing in accordance with the preceeding paragraph title in the goods shall remain with the company and shall not pass to the customer until the amount due as per the invoice (including interest and costs) has been paid in full.
- All care is taken by the Company to supply stock of the highest quality and true to name, in accordance with the relevant British Standards and handled within C.P.S.E. guidelines. However the Company cannot take responsibility for plant welfare and productiveness once delivery has been accepted.
- Stock. All plants are offered subject to crop and being unsold upon receipt of order. We reserve the right to substitute without notification, one variety to the nearest unless otherwise specified by the customer.
- Cancellation. Cancellation of orders must be in writing. If an order is cancelled either wholly or partially, we reserve the right to charge 30% of the value cancelled as liquidated damages without the need to prove it’s action.
- Label liability. All care is taken to supply stock that is true to name. It is the customer’s responsibility to check accuracy of labels upon receipt of delivery. Errors must be notified within seven days and Mahood Brothers Limited will be liable to replacement of labels.
- Reserve ordering. A delivery date will be confirmed for all reserve orders. We will notify customers when reserve stock is at its best for delivery. We reserve the right to sell all stock that is not taken immediately. Our terms and conditions will apply to all deliveries from reserve orders.
- Delivery. Prices are inclusive of packing and delivery charges (U.K. Mainland only) for orders £600.00 and over (excluding V.A.T.) On orders below this value and to other destinations, packing and delivery is charged at cost. Non mainland deliveries will incur additional carriage charges by agreement. Where deliveries are made on tagged Danish Trolleys these must be exchanged on a one to one basis at the time of delivery. Trolleys not exchanged at the time of delivery may be charged for at replacement value and then credited upon subsequent return.
- Fuel surcharge. We reserve the right to add a fuel surcharge should the price of diesel rise above £1.50 / litre.
The placing of an order with us implies the Customer’s acceptance of the Terms and Conditions in every respect.
